Abstract
ABSTRAK. Netralitas Aparatur Sipil Negara (ASN) di Indonesia merupakan problem laten dan kompleks. Pelayanan publik dan demokrasi akan terganggu apabila birokrasi tidak netral. Salah satu penyebab keberpihakan ASN dalam pemilihan umum/pemilihan kepala daerah karena kepentingan karier. Faktor penyebab pelanggaran netralitas ASN diantaranya kurangnya pengawasan dan rendahnya sanksi terhadap pelanggar. Terbitnya Peraturan Pemerintah (PP) Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil (PNS) telah memberikan dukungan dalam penegakan netralitas PNS. PP Nomor 94 Tahun 2021 mengatur lebih rinci larangan bagi PNS terkait netralitas dalam pemilihan umum maupun pemilihan kepala daerah, terutama yang sebelumnya tidak diatur dalam PP Nomor 53 Tahun 2010.
Abstract. The neutrality of the State Civil Apparatus (ASN) in Indonesia is a latent and complex problem. Public service and democracy will be disturbed if the bureaucracy is not neutral. One of the causes of ASN's alignment in the general election/regional head election is due to career interests. The factors that cause violations of ASN neutrality include lack of supervision and low sanctions against violators. The issuance of Government Regulation (PP) Number 94/2021 concerning Discipline of Civil Servants (PNS) has provided support in the enforcement of the neutrality of civil servants. PP Number 94/2021 regulates in more detail the prohibition for civil servants related to neutrality in general elections and regional head elections, especially those that were not previously regulated in Government Regulation Number 53/2010.
